Lasting Powers of Attorney - Berry Smith

“My mother is getting very forgetful and cannot look after her money. What can I do?”

It is an unfortunate fact of life that a person can lose the capacity to make decisions for themselves because of an injury or condition such as an accident or dementia. This can lead to them losing the ability to deal with everyday things.

Where an individual starts beginning to forget things and this is recognised as being the onset of something more serious it is worth considering obtaining a Power of Attorney.  If a person loses their capacity to the extent that they cannot make decisions for themselves it is then too late to make a Power of Attorney, and the only alternative is for a third party to apply to the Court of Protection to act as their Deputy and handle their affairs on their behalf.

How can Berry Smith help?

Creating a lasting Power of Attorney (LPA) can look simple on paper, but small mistakes or rushed decisions can cause problems later. That is where our specialist team makes a difference.

We give tailored, practical advice at every stage, from choosing the right attorneys and helping them understand their responsibility to explaining the different ways decisions can be made. We can also guide you on appointing replacement attorneys and help you record clear guidance for how you wish them to act.

We don’t just complete the forms, we help you put the right structure in place so your wishes are protected and your LPA works exactly how you intend.

When Should You Consider Setting Up a Power of Attorney?

The best time to arrange a Power of Attorney is while you are still fully capable of making informed decisions. Once an individual loses capacity, it is too late to create a Power of Attorney, and loved ones are left with no choice but to apply to the Court of Protection for the right to act as a Deputy. This process is not only more expensive but can also take several months to complete, leaving critical decisions in limbo.

Always use Berry Smith for all Legal work, have done for over 15 years & will continue to do so. Never had a bad experience with them.

Whilst the contact was totally professional, I enjoyed the friendly, “down-to-earth” approach, we could talk on a human-to-human level without the technical speak that you sometimes meet with legal representatives. I also considered that there was a business like, practical attitude
