Resolution’s Good Divorce Week 2025: Finding a Better Way Forward

This week marks the start of Resolution’s Good Divorce Week – an opportunity to shine a light on this positive, forward-thinking approach to family law. It’s about showing that there is a better way – one that prioritises compassion, communication, and constructive resolution over confrontation.

The need for a better way

The Family Courts are under immense pressure, with the court system overwhelmed with the number of cases it handling – leading to severe delays. These delays have the knock on effect, often leaving families in limbo until their case comes before the court.

At Berry Smith, we see the real impact these delays, combined with the understandable stress a divorce will naturally bring, have on separating couples – uncertainty, stress, and the emotion of both parties and any family involved. However, we also see that there is a better way; with the right approach, families can reach lasting solutions without the need for lengthy, adversarial proceedings.

Court should always be the last resort. Whilst we acknowledge that Court might be the only way forward, and necessary, in some cases to resolve disputes, many cases can be resolved outside the court process entirely, through open communication and early professional and legal support.
