Enduring and Lasting Powers of Attorney and Incapacity

There are many reasons to appoint an attorney, including incapacity and illness. An Enduring Power of Attorney enables someone to look after your affairs and you can choose who that will be.

In 2007 you will be able to make a Lasting Power of Attorney that will enable you to appoint someone to make decisions regarding your health and welfare as well as look after your financial affairs. The process of making a Lasting Power of Attorney is more complex that an Enduring Power of Attorney and we can explain and assist with these important changes.

If a person is unable to manage their affairs and Enduring or Lasting Power of Attorney is not in place then the management of their affairs will have to be placed in the hands of a third party who will handle matters on that person’s behalf. We will assist in all aspects of the appropriate applications to the court to obtain the necessary orders so that the affai9rs of the incapacitated person can be managed with as little interruption as possible.
