Collaborative Law and Mediation
Berry Smith is at the forefront of the Collaborative practice, a very new approach to the resolution of family breakdown.
The main principle behind the practice is that all parties and lawyers formally agree to reach a settlement directly through negotiation without the necessity of resorting to a contest through the Court process. Parties work together through a series of face to face meetings in resolving all issues relating to their children, home and other assets.
As a result, the parties control the process, costs are minimized and good will and cooperation maintained and improved.
Berry Smith can also offer independent mediation, whereby parties are referred to a sole or joint mediation service, who will provide information to both parties in a controlled forum which they will try and resolve their dispute.
