Erica Westerman

Erica is a partner at Berry Smith and Head of the Commercial & IP team. Erica joined Berry Smith in 2003 from a large international law firm, set up the Commercial & IP team in 2005 and became a partner of the business in 2011.   She has successfully grown the team achieving growth year on year and frequently advises her extensive SME client base on a wide range of commercial, information technology (IT) and intellectual property (IP) matters.

Erica’s experience in drafting commercial contracts includes agency, distribution, manufacturing, OEM, standard terms and conditions of sale and franchise agreements. 

She also frequently advises on IT related matters including software licensing and development; support and maintenance and hardware installation agreements and has wide ranging experience advising on IP, including the existence, development, ownership and exploitation of a wide range of IP rights. Erica has gained British Franchise Association affiliation for the firm and is cited in Legal 500 guide to the legal profession as "responsive and proactive".

Recent instructions include:

•  Ongoing negotiating and drafting of Development and Manufacturing Agreements for a world leading diagnostics company on its contracts with household pharmaceutical companies;
• Advising one of the largest construction companies in South Wales on securing critical intellectual property rights;
• Drafting terms and conditions of sale and supply contracts for a market leading sofa manufacturing company; and
• Advising a long established, leading and global IT solution provider on its contracts with major international blue-chip corporates.
