Mediation
We regularly represent clients in mediation in relation to disputes. Mediation is a route gaining popularity and is often an effective way in which to resolve disputes.
Mediation operates by the disputing parties agreeing to appoint an independent mediator to facilitate discussions between them. The mediation usually takes place on one day with all parties present, and can occur at any time of the dispute. A mediator does not decide who is right or wrong, but acts as a go between, exploring each party’s case with them privately and aiding the negotiation process.
Mediation is voluntary and confidential. If the parties reach agreement then the agreement becomes binding and legally enforceable.
In our experience, mediation is particularly beneficial in obtaining creative solutions and can be effective in solving problems and re preserve relationships between parties.
In addition to regularly representing parties in negotiations, Nick Parker is an ADR Group accredited mediator. Nick also accepts direct instructions from parties to act as mediator in their disputes.
